Indore News: हाईकोर्ट ने बच्ची को कनाड़ा भेजने से किया इनकार, कहा- विदेशी कोर्ट का आदेश बाध्यकारी नहीं

मध्य प्रदेश की इंदौर हाईकोर्ट ने कनाडा की फैमिली कोर्ट में दायर हैबियस कॉर्पस याचिका को खारिज करते हुए दस साल की बच्ची को कनाडा स्थित पिता के पास भेजने से इनकार कर दिया और कहा कि विदेशी कोर्ट का आदेश बाध्यकारी नहीं है। कोर्ट ने कहा कि बच्चों के मामले में उनका हित सर्वोपरि है, न कि माता-पिता का कानूनी अधिकार। यदि विदेशी आदेश को लागू करना बच्चे के हित के खिलाफ है, तो भारतीय अदालत उस आदेश को लागू करने के लिए बाध्य नहीं है।


 

कोर्ट ने अपने आदेश में वाल्मीकि रामायण का उल्लेख करते हुए कहा कि ‘माता सीता के श्रीराम से अलग होने के बाद लव और कुश का पालन-पोषण उनकी मां ने महर्षि वाल्मीकि के आश्रम में किया। श्रीराम अयोध्या के राजा और उनके पिता होने के बावजूद बच्चे मां के साथ ही रहे, जो भावनात्मक सुरक्षा, नैतिक पालन-पोषण और मातृत्व संरक्षण को दर्शाता है।’

 

याचिकाकर्ता ने ओंटारियो (कनाडा) की सुपीरियर कोर्ट ऑफ जस्टिस की फैमिली कोर्ट के आदेश के आधार पर बच्ची को अपने पास कनाडा भेजने की मांग की थी। कोर्ट ने अपने आदेश में संस्कृत के उस श्लोक का भी उल्लेख किया, जिसमें कहा गया है कि ‘माता और मातृभूमि स्वर्ग से भी बढ़कर है।’

 

यह है मामला

बच्ची के माता-पिता का विवाह 2014 में महाराष्ट्र में हुआ था और बाद में वे अमेरिका चले गए। बच्ची का जन्म 2016 में शिकागो में हुआ और उसे जन्म से अमेरिकी नागरिकता मिली। इसके बाद परिवार टोरंटो, कनाडा चला गया।

 

जनवरी 2022 में महिला अपनी बेटी के साथ भारत आई और वापस लौटने के बजाय बच्ची का दाखिला इंदौर के एक स्कूल में करा दिया। इस बात को लेकर पति-पत्नी के बीच विवाद शुरू हुआ और पिता ने बच्ची को कनाडा भेजने की मांग की। इसके लिए उसने हाईकोर्ट में याचिका दायर की।


 

हाईकोर्ट ने सुप्रीम कोर्ट के फैसलों का हवाला देते हुए कहा कि विदेशी अदालत का आदेश केवल एक कारक है, लेकिन बच्चे का कल्याण सर्वोपरि है। बच्ची को कोर्ट के सामने पेश किया गया और न्यायाधीशों ने उससे अपने कक्ष में बातचीत की, जिसमें उसने अपनी मां के साथ रहने की इच्छा जताई।

Spotlight on pole vaulters at Indian Indoor Combined events start in Bhubaneswar <div id="content-body-70928375" itemprop="articleBody"><p>National record holders Dev Kumar Meena of Madhya Pradesh and Baranica Elangovan of Tamil Nadu will be among the top draws in the inaugural Indian Indoor Open Combined Events and Pole Vault Competition, which begins in Bhubaneswar on Saturday.</p><p>The two-day meet will be held at the indoor facility at the Kalinga Stadium complex, which hosted the inaugural National Indoor Championships in March. The facility will also host the World Indoor Championships in 2028.</p><p>Meena has had an impressive season. In March, he equalled his national record of 5.40m during an invitational meet in Taiwan.</p><p>“My goal here in Bhubaneswar is to do my personal best. I enjoyed my practice sessions at the Kalinga Stadium indoor facility. I’m ready to do my best,” the 20-year-old said.</p><p>The men’s pole vault qualification mark set by the Athletics Federation of India for the 2026 Glasgow Commonwealth Games is 5.25m. The qualification mark for women is 4.45m.</p><p>The men’s qualification standard for the Asian Games in Japan later this year is 5.45m, while the corresponding mark for women is 4.10m.</p><p>Fourteen pole vaulters will compete in the men’s event, scheduled for the opening day on Saturday.
