प्रयागराज। ज्योतिष पीठ के शंकराचार्य स्वामी अविमुक्तेश्वरानंद सरस्वती की मुश्किलें बढ़ती नजर आ रही हैं। कथित यौन उत्पीड़न और पोक्सो (POCSO) एक्ट जैसी गंभीर धाराओं के तहत दर्ज एफआईआर के बाद, स्वामी अविमुक्तेश्वरानंद ने अपनी गिरफ्तारी से बचने के लिए इलाहाबाद उच्च न्यायालय का दरवाजा खटखटाया है। उनके अधिवक्ताओं के माध्यम से ‘अग्रिम जमानत याचिका’ (Anticipatory Bail) दाखिल की गई है, जिस पर जल्द ही सुनवाई होने की संभावना है।

यह पूरा मामला प्रयागराज के झूंसी थाने में दर्ज मुकदमे से जुड़ा है, जिसमें शंकराचार्य के साथ उनके शिष्य और कुछ अज्ञात लोगों को भी आरोपी बनाया गया है।

क्या है पूरा मामला? कोर्ट के आदेश पर दर्ज हुई FIR
स्वामी अविमुक्तेश्वरानंद के खिलाफ यह कानूनी कार्रवाई तुलसी पीठाधीश्वर स्वामी रामभद्राचार्य के शिष्य आशुतोष ब्रह्मचारी की अर्जी पर शुरू हुई है। आशुतोष ब्रह्मचारी ने जिला न्यायालय (एडीजे रेप एवं पोक्सो स्पेशल कोर्ट) में धारा 173(4) के तहत अर्जी दाखिल कर गंभीर आरोप लगाए थे।

मामले की गंभीरता को देखते हुए विशेष न्यायाधीश विनोद कुमार चौरसिया ने झूंसी पुलिस को मुकदमा दर्ज कर गहन विवेचना के आदेश दिए। कोर्ट के इसी आदेश के अनुपालन में पुलिस ने स्वामी अविमुक्तेश्वरानंद, उनके शिष्य मुकुंदानंद गिरि और दो-तीन अज्ञात व्यक्तियों के विरुद्ध प्राथमिकी दर्ज की।

दर्ज की गई प्रमुख धाराएं:
भारतीय न्याय संहिता (BNS) की धारा 351(3)।
लैंगिक अपराधों से बालकों का संरक्षण अधिनियम (POCSO Act) की धारा 5l, 6, 3, 4(2), 16 और 17।

हाईकोर्ट में दी गई दलीलें: गिरफ्तारी पर रोक की मांग
गिरफ्तारी की आशंका को देखते हुए स्वामी अविमुक्तेश्वरानंद ने अधिवक्ता राजर्षि गुप्ता, सुधांशु कुमार और श्री प्रकाश के जरिए इलाहाबाद हाईकोर्ट में याचिका पेश की है। याचिका में दलील दी गई है कि उनके खिलाफ लगाए गए आरोप पूरी तरह निराधार हैं और उन्हें केवल उनकी प्रतिष्ठा धूमिल करने के उद्देश्य से फंसाया जा रहा है। अब सबकी नजरें हाईकोर्ट के रुख पर टिकी हैं कि क्या स्वामी को गिरफ्तारी से अंतरिम राहत मिलती है या नहीं।

शंकराचार्य का पलटवार: “यह सनातन को नष्ट करने की साजिश”
इन गंभीर आरोपों पर स्वामी अविमुक्तेश्वरानंद ने कड़ा रुख अपनाया है। वाराणसी में मीडिया से बातचीत करते हुए उन्होंने इसे ‘काल्पनिक कहानी’ और ‘हिंदू धर्म के शत्रुओं की चाल’ करार दिया।

स्वामी अविमुक्तेश्वरानंद के बचाव के मुख्य तर्क
छात्रों की पहचान पर सवाल: स्वामी का दावा है कि जिन लड़कों के साथ दुर्व्यवहार की बात कही जा रही है, वे कभी उनके गुरुकुल या आश्रम में रहे ही नहीं।
मार्कशीट का प्रमाण: उन्होंने दावा किया कि उन छात्रों की मार्कशीट इस बात का सबूत है कि वे हरदोई के एक स्कूल के छात्र हैं। जब उनका आश्रम से कोई संबंध ही नहीं है, तो घटना की संभावना ही पैदा नहीं होती।
सीडी का रहस्य: उन्होंने सवाल उठाया कि अगर आरोपों से जुड़ी कोई सीडी होने का दावा किया जा रहा है, तो उसे सार्वजनिक क्यों नहीं किया जाता? उन्होंने इसे केवल भ्रम फैलाने का जरिया बताया।

“गिरफ्तारी का विरोध नहीं करेंगे”: संघर्ष का संकल्प
अविमुक्तेश्वरानंद ने घोषणा की है कि वे कानून की प्रक्रिया का सम्मान करेंगे। उन्होंने कहा, “भले ही पुलिस हमें गिरफ्तार करने की कार्रवाई करे, हम उसका विरोध नहीं करेंगे। हम पूर्ण सहयोग करेंगे। सत्य अंततः उजागर होगा और यह झूठी कहानी ध्वस्त हो जाएगी।” उन्होंने अपने विरोधियों पर कटाक्ष करते हुए कहा कि कुछ लोग ‘हिंदू का चोला’ पहनकर सनातन धर्म को नष्ट करने के लिए सुपारी लेकर आए हैं। उन्होंने जनता से अपील की कि वे इस साजिश को समझें और सच का साथ दें।

धार्मिक और प्रशासनिक गलियारों में हलचल
शंकराचार्य जैसे उच्च पदस्थ संत पर इस तरह के आरोपों ने संत समाज और प्रयागराज के प्रशासनिक हलकों में खलबली मचा दी है। एक ओर जहाँ उनके समर्थक इसे धार्मिक विद्वेष बता रहे हैं, वहीं दूसरी ओर पुलिस साक्ष्यों के संकलन और विवेचना में जुटी है। झूंसी पुलिस ने मामले की डायरी तैयार कर ली है और गवाहों के बयान दर्ज करने की प्रक्रिया शुरू कर दी है।

6 मार्च की सुनवाई और भविष्य की राह
प्रयागराज में चल रहा यह कानूनी संघर्ष अब केवल एक आपराधिक मामला नहीं, बल्कि एक वैचारिक युद्ध बन गया है। यदि हाईकोर्ट से स्वामी को राहत नहीं मिलती, तो पुलिस किसी भी समय उन्हें हिरासत में ले सकती है। आने वाले दिन न केवल स्वामी अविमुक्तेश्वरानंद के लिए बल्कि ज्योतिष पीठ की गरिमा के लिए भी अत्यंत महत्वपूर्ण होने वाले हैं।
