Indore News: इंदौर में कांग्रेस पार्षद अंसारी का निर्वाचन जिला कोर्ट ने शून्य घोषित किया

इंदौर नगर निगम के वार्ड-60 के पार्षद चुनाव को लेकर जिला न्यायालय ने महत्वपूर्ण फैसला सुनाते हुए निर्वाचित पार्षद सुनेहरा अंसारी का निर्वाचन शून्य घोषित कर दिया है। न्यायालय ने माना कि नामांकन के दौरान प्रस्तुत शपथपत्र में उम्मीदवार ने अपनी एवं परिवार की संपत्ति, देनदारियों और अन्य आवश्यक जानकारियों का पूरा और सही खुलासा नहीं किया। अदालत ने इसे मध्यप्रदेश नगर पालिक निगम निर्वाचन नियम, 1994 के नियम 24-ए का उल्लंघन माना।

 

यह चुनाव याचिका पूर्व पार्षद इफ्तेखार अंसारी ने दायर की थी। उन्होंने आरोप लगाया था कि निर्वाचित उम्मीदवार ने संपत्तियों, नगर निगम के बकाया कर और अन्य वित्तीय विवरणों को छिपाया और शपथपत्र में अधूरी और गलत जानकारी दी। न्यायालय ने उपलब्ध दस्तावेजों और साक्ष्यों के आधार पर पाया कि उम्मीदवार ने आवश्यक जानकारियों का सही खुलासा नहीं किया, जिससे मतदाताओं के जानकारी के अधिकार पर असर पड़ा। हालांकि, चुनाव में भ्रष्ट आचरण से जुड़े आरोप सिद्ध नहीं हुए।


फैसले में अदालत ने सुनेहरा अंसारी का निर्वाचन निरस्त कर दिया, लेकिन चुनाव याचिका में दूसरे प्रत्याशी यासमीन अंसारी को सीधे विजेता घोषित करने की मांग स्वीकार नहीं की। अदालत ने स्पष्ट किया कि निर्वाचित उम्मीदवार का चुनाव शून्य घोषित किया जाता है, जबकि दूसरे प्रत्याशी को निर्वाचित घोषित करने के लिए आवश्यक कानूनी आधार इस मामले में सिद्ध नहीं हुए। इस प्रकार चुनाव याचिका आंशिक रूप से स्वीकार की गई।याचिकाकर्ता की पत्नी ने सुनेहरा के खिलाफ चुनाव लड़ा था, लेकिन वे जीत नहीं पाई थी। अब मामला हाईकोर्ट में जा सकता है।
