नईदुनिया प्रतिनिधि, इंदौर। विशेष न्यायालय (एमपी-एमएलए) ने आगर-मालवा जिले के बड़ौद थाना क्षेत्र में शासकीय कार्य में बाधा डालने और पुलिसकर्मियों को धमकाने के मामले में पूर्व विधायक एवं कांग्रेस जिलाध्यक्ष विपिन वानखेड़े सहित आठ आरोपितों को संदेह का लाभ देते हुए दोषमुक्त कर दिया।

न्यायालय ने अपने निर्णय में स्पष्ट किया कि किसी मुद्दे को लेकर जनप्रतिनिधि या आम नागरिक का पुलिस अधिकारियों से बहस या तर्क-वितर्क करना मात्र शासकीय कार्य में बाधा का अपराध नहीं माना जा सकता।

इसके लिए यह साबित होना आवश्यक है कि लोक सेवक पर हमला किया गया हो या उसके विरुद्ध आपराधिक बल का प्रयोग किया गया हो। मामले की सुनवाई के दौरान न्यायालय ने उपलब्ध साक्ष्यों, सीसीटीवी फुटेज और पूरे घटनाक्रम का विस्तृत परीक्षण किया। पर्याप्त और स्पष्ट साक्ष्य के अभाव में अदालत ने सभी आरोपितों को दोषमुक्त कर दिया।

2020 में दर्ज हुआ था मामला

मामला 23 नवंबर 2020 का है। बड़ौद थाना के तत्कालीन थाना प्रभारी ने आरोप लगाया था कि तत्कालीन विधायक विपिन वानखेड़े अपने समर्थकों के साथ थाने पहुंचे और शासकीय कार्य में बाधा डाली। पुलिस ने इस मामले में प्रकरण दर्ज कर न्यायालय में चालान प्रस्तुत किया था।

वीडियो फुटेज में नहीं मिला धक्का-मुक्की का प्रमाण

मामले की सुनवाई के दौरान न्यायालय ने अभिलेखों पर उपलब्ध साक्ष्यों, सीसीटीवी फुटेज और पूरे घटनाक्रम का सूक्ष्मता से परीक्षण किया। अदालत ने पाया कि प्रस्तुत वीडियो फुटेज में ऐसा कोई स्पष्ट प्रमाण नहीं है, जिससे यह सिद्ध हो सके कि आरोपितों ने थाना प्रभारी या किसी अन्य पुलिसकर्मी के साथ धक्का-मुक्की अथवा हाथापाई की थी।

बहस को नहीं माना जा सकता शासकीय कार्य में बाधा

  • न्यायालय ने अपने आदेश में कहा कि किसी विषय को लेकर जनप्रतिनिधियों या आम नागरिकों का पुलिस अधिकारियों से वाद-विवाद या तर्क-वितर्क करना अपने आप में अपराध नहीं है। जब तक यह सिद्ध न हो कि आरोपित ने किसी लोक सेवक पर हमला किया या उसके विरुद्ध आपराधिक बल का प्रयोग किया, तब तक शासकीय कार्य में बाधा का अपराध नहीं बनता।
  • न्यायालय ने यह भी कहा कि घटना के स्पष्ट और प्रत्यक्ष इलेक्ट्रॉनिक साक्ष्य उपलब्ध होने की संभावना थी, लेकिन ऐसे साक्ष्य प्रस्तुत नहीं किए गए। इन्हीं परिस्थितियों को देखते हुए अदालत ने पूर्व विधायक विपिन वानखेड़े सहित सभी आठ आरोपितों को संदेह का लाभ देते हुए दोषमुक्त कर दिया।

It seems the company isn’t just winning the moral argument on this front, but the legal one, too. According to Axios, the judge hearing Anthropic’s challenge to the Trump administration’s designation has thus far not found the Pentagon’s case to be particularly compelling.</p> <p>Per the report, U.S. District <a href="https://www.axios.com/2026/07/30/judge-pentagon-case-worse-anthropic">Judge Rita Lin wasted little time pouring cold water</a> on the federal government’s position. “I don’t see additional evidence from the government really justifying what it did. If anything, it seems like the record, in some ways, has gotten worse for the government,” she reportedly said.</p> <p>She also did not seem convinced by the Pentagon’s apparent argument that it was concerned Anthropic would mess with its model to prevent the military from using it how they intended. “I don’t see evidence that Anthropic could alter the model after it was delivered or flip some kind of kill switch,” she said, per Axios.</p> <p>This doesn’t come as a major surprise, given Judge Lin’s general vibe since this case landed in her court. Back in March when Anthropic first brought its challenge to the government’s designation, the judge <a href="https://www.axios.com/2026/03/24/judge-pentagon-anthropic-troubling">said</a> that “it looks like an attempt to cripple Anthropic.” She ultimately granted a temporary injunction on the government’s attempt to basically blacklist the AI firm.</p> <p>You’ll recall the origin of this whole fight came earlier this year when negotiations between Anthropic and the Department of Defense fell through after the company <a href="https://gizmodo.com/anthropic-tells-pete-hegseth-to-take-a-hike-2000727450">refused to agree</a> to a deal that would have allowed the Pentagon to use its AI models for “all lawful purposes.” Anthropic reportedly sought to clarify that it <a href="https://gizmodo.com/pentagon-reportedly-hopping-mad-at-anthropic-for-not-blindly-supporting-everything-military-does-2000722286">would not include</a> using the model to launch weapons without human involvement or to perform surveillance on American citizens. The Pentagon was unwilling to agree to honor Anthropic’s redlines.</p> <p>Under a normal administration, that would likely just lead to the government moving on to another company. Under the Trump administration, though, refusal to comply makes you an enemy of the country. Trump and company moved to <a href="https://gizmodo.com/anthropic-tells-pete-hegseth-to-take-a-hike-2000727450">label Anthropic a supply chain risk</a>, a designation typically reserved for foreign adversaries, not domestic companies. Getting slapped with that tag meant the <a href="https://federalnewsnetwork.com/artificial-intelligence/2026/02/anthropic-refuses-to-bend-to-pentagon-on-ai-safeguards-as-dispute-nears-deadline/">rest of the federal government</a> would have to stop doing business with Anthropic, which would be a blow to the company.</p> <p>Instead, the whole thing is in limbo—though it’s not looking great for the administration. Of course, they could just cancel the contracts and do business with less scrupulous AI companies.
